1. Privacy


Givium Foundation ("us," "we," "our", or "Givium") is committed to respecting the privacy of our customers, visitors, and anyone who uses our online services (collectively, "Services") delivered through our website, web application, and any software applications across platforms (iOS, Android, etc.) that you download, access, or use (collectively, the "Software"). This privacy policy ("Privacy Policy") exists to give you confidence in how your information is handled and to demonstrate our dedication to protecting any personal data we hold.
Givium takes full responsibility for the personal information we gather and maintain. We have developed this Privacy Policy and ensured our team is trained on our practices to uphold our accountability to you. This Privacy Policy applies only to individual users of the Software and/or Services, and does not apply to businesses or other organizations. Our Software may include links to external websites or integrations with third-party software. Those external sites and components are outside our control and are not covered by this Privacy Policy. Likewise, our Software may appear within third-party platforms we do not manage, and those platforms are not bound by this Privacy Policy. We encourage you to review the privacy policies of any third-party sites or applications you visit. Your use of our Software is subject to both this Privacy Policy and our Terms of Use. Givium Foundation embraces the principles of the Canadian Standards Association Model Code for the Protection of Personal Information and manages the collection, access, use, retention, disclosure, and disposal of personal information in keeping with those principles.

2. Software and Technical Data Collected


When you use our Software, we automatically gather certain technical information, including: (1) IP addresses; (2) domain servers; (3) the type of device or computer you are using, including operating system version; (4) browser type; (5) the source that directed you to our Software; and (6) other data related to how your browser interacts with our Software (collectively, "Software Data"). Additional Software Data we may collect on an ongoing basis includes full URL paths, clickstream data (including timestamps), pages visited or searched, page load times, download errors, time spent on pages, and how you interact with page elements such as scrolling, clicking, or hovering.
We may also collect geolocation data, device security status, and other similar device information to improve your experience, protect against fraud, and manage risk.

3. Personal Information Collected


We deliver our Services through the Software. To access certain features, you may be asked to provide information that identifies you or from which your identity could reasonably be determined (collectively, "Personal Information"). This may include: (1) Contact Information such as your name, email address, and phone number; (2) Demographic Information such as your age and gender; and (3) Location Information such as your address or postal code. Any 
information you share with us through email, mail, or other correspondence may also be treated as Personal Information. You are not required to provide Personal Information. However, if you choose not to, certain features or portions of the Software may be unavailable to you, and the Services may be less tailored to your needs. If any part of the Services requires a username and password, you are solely responsible for maintaining their confidentiality. With your consent, we collect information about you for the following purposes:
To establish and verify your identity.
To ensure we hold accurate and up-to-date information about you.
To administer your donations and maintain your giving history.
To process your transactions, including Monthly Contributions, payment processing, and the issuance of tax receipts.
To respond to your information requests and communicate with you, including sending updates and acknowledgements of your support.
To generate statistics and aggregate reporting that helps us and our Charity Partners understand community impact.
To meet all applicable provincial and federal legal and regulatory requirements.
To investigate legal claims and protect against fraudulent actors, behaviours, and transactions.
To protect Givium Foundation against legal, regulatory, financial, or business risks.
For any other purpose permitted by law or with your explicit consent.

4. How We Collect Information


We collect, use, and disclose your personal information with your permission, except where otherwise required or permitted by law. Your permission may be express provided electronically or in writing or implied through your actions or inaction, such as your use of the Platform.
We gather information including both Software Data and Personal Information through a variety of means:
Directly from you, when you complete forms, take part in surveys or quizzes, create an account, or reach out to us by phone, email, or other channels.
Through your contributions, when you submit content intended for display within the Software or for sharing with other users or third parties.
Automatically, as you navigate and interact with our Services. This may include usage details, IP addresses, and data gathered through cookies and similar tracking technologies.
From third-party or publicly available sources, such as partner organizations or publicly accessible datasets.
Information collected directly through our Services may include:
Details you submit via forms or input fields, including at account registration, during general use, or when requesting support. We may also request information if you participate in a contest or promotion, or report a technical issue.
Records of any correspondence you send us, including email addresses.
Your responses to surveys or research queries we may invite you to complete, whether within or outside the Software.

5. Cookies


Cookies are small data files placed on your device when you visit a website. They can store various types of information, including your preferences and browsing behaviour. You may choose to block or delete cookies at any time, though doing so is at your own discretion and may limit your access to certain features of the Software.
We use cookies primarily to personalize your experience on our platform and to remember your login credentials so you are not required to sign in on every visit. We may also use cookies and similar technologies to observe your online activity over time for the purpose of behavioural analysis. Information stored in cookies may be connected to Personal Information you have submitted through the Software. Automatically collected data is generally statistical in nature and does not on its own constitute Personal Information. It helps us improve our Services by allowing us to:
Measure audience size and usage trends.
Store your preferences so we can tailor the Software to your interests.
Improve the speed and performance of your searches.
Recognize returning users.

6. Retention of Information


Unless otherwise required or permitted by law, we retain your Personal Information only for as long as needed to fulfill the purposes for which it was collected, including any legal, accounting, or regulatory obligations. In some cases, we may anonymize your Personal Information so it can no longer be linked to you. We reserve the right to use such anonymized or de-identified data, along with Software Data, for legitimate business purposes at any time, without additional notice or consent.


7. Applicable Privacy Legislation


All businesses engaged in commercial activities in Canada are required to comply with the Personal Information Protection and Electronic Documents Act ("PIPEDA"), along with the Canadian Standards Association Model Code for the Protection of Personal Information and applicable provincial privacy legislation. PIPEDA grants you certain rights with respect to your personal data. If you are based outside of Canada, your local laws may also provide protections regarding how your personal information is collected and used.


8. How Givium Uses Your Information


We may use information collected from you, including Personal Information, for the following purposes:
To deliver the Services and their associated content, including responding to requests you make.
To process your Monthly Contributions and issue tax receipts for your donations.
To send you updates or communications about Givium Foundation, our Charity Partners, our products, or our Services.
To fulfill the purpose for which the information was provided, or any related purpose described at the time of collection.
To enable you to participate in interactive or community features within the Software.
To contact you when necessary, such as to notify you of changes to the Services.
To personalize your experience within the Software.
For any other purpose described at the time of collection, or with your explicit consent.

9. Sharing and Disclosure of Information


Givium Foundation does not sell your personal information to any third party, under any circumstances.
Beyond the uses described above, we may share certain categories of your information as outlined in this Privacy Policy.
We may share your information with our subsidiaries and affiliated entities where necessary to deliver our Services, such as sharing required information to process a donation (for example, payment details needed to complete a credit card transaction).
We may share Demographic and Location Data with third parties, but only in aggregated, non-personally-identifiable form. Where we deliver Services in partnership with a third-party organization, we may share relevant Personal Information with that organization to the extent necessary to fulfill the service or respond to a request you have made. We will not disclose more information than is reasonably required for that purpose. We work with third-party business partners who support our core operations. These partners are required to maintain the same standards of confidentiality and security we uphold, and may only. use your Personal Information to fulfill their specific obligations in connection with our Services. We may also transfer your information to a third party in the event of a merger, acquisition, or sale involving Givium Foundation. Any third-party service provider who may have access to personal information through their role in supporting our operations is required to maintain strict confidentiality and is bound by appropriate confidentiality obligations before being granted such access. We may share your Personal Information and Software Data with contractors or service providers who help integrate different software components to deliver a seamless user experience. We may also disclose your information to comply with applicable law, a court order, or legal process; to respond to a government or regulatory inquiry; to enforce our Terms of Use; or where we reasonably believe disclosure is necessary to protect the rights, safety, or property of Givium Foundation, our partners, or others. Unless otherwise indicated, Personal Information will be stored and processed in Canada.
10. Controlling and Correcting Your Personal Information

Keeping your Personal Information accurate is important to the quality of our Services. If your information changes, please let us know so we can update our records. Registered users may be able to update certain details directly through their account profile.
Upon written request, we will make reasonable efforts to delete your account and the associated Personal Information. However, complete removal may not always be possible, and some residual data may be retained. To request account closure, please contact us at the address listed in Section 18.
If we hold inaccurate Personal Information about you, we will take reasonable steps to correct it upon verification.
Where you have consented to the collection, use, or transfer of your Personal Information, you may have the right to withdraw that consent at any time. Please note that doing so may affect your ability to access certain features or Services. We will explain any impact before you make your decision.

11. Access to Your Personal Information


You may submit a written request to access any Personal Information we hold about you. Summary information is available upon request. Requests requiring retrieval from archives or other records may be subject to reasonable fees.

Your right of access is not unconditional. We may decline a request where:

Denial is required or authorized by law.
The information relates to existing or anticipated legal proceedings involving you.
Granting access would unreasonably affect the privacy of another individual.
Doing so would interfere with ongoing negotiations with you.
It is necessary to protect our rights or property.
The request is frivolous or made in bad faith.
If we deny a request for access or correction, we will provide an explanation.


12. Security


We take the security of your Personal Information seriously and apply reasonable measures to protect it from loss, unauthorized access, alteration, or disclosure.
These measures include:

Restricted access to files containing personal data.
Technical safeguards including encryption, security software, and firewalls.
Internal password and access control policies.
Be aware that "phishing" scams may attempt to impersonate Givium Foundation to obtain your personal details. We will never ask for your password, username, credit card information, or other sensitive Personal Information via email. If you receive such a request, do not respond.
No software or online platform can be guaranteed to be entirely free from unauthorized intrusion. We also do not control the networks over which you transmit information to us, and cannot prevent all interceptions that may occur in transit. If we become aware that your Personal Information has been disclosed in a way that is inconsistent with this Privacy Policy, we will make reasonable efforts to notify you as soon as practicable. You also play a role in your own security. If you have been assigned or have chosen a password to access our Services, please keep it confidential and do not share it with others.

13. Lost or Stolen Information


If your Contact Data is lost, stolen, or accessed without your authorization, please notify us promptly. We will remove that information from your account and update our records accordingly.


14. Third-Party Integrations


Our Software may link to or integrate with third-party websites and services with which Givium Foundation has no formal affiliation. Except as described in this Privacy Policy, we do not share your Personal Information with those providers and are not responsible for their privacy practices. Some third-party platforms may appear similar to ours please take care to verify you are using Givium's Platform and not a third party's. We recommend reviewing the privacy policy of any external service you choose to use.


15. Updates to This Privacy Policy


We review our policies regularly and may update this Privacy Policy from time to time. Any changes will be posted to our website and will take effect immediately. Your continued use of the Software following any update constitutes your acceptance of the revised Privacy Policy.


16. Email Communications


Please be aware that email is not a fully secure communication channel. Exercise appropriate caution when sending or receiving personal or sensitive information by email.


17. Limitation of Liability


Givium Foundation makes no guarantee as to the absolute security, integrity, or confidentiality of information transmitted to or from the Software. While we take reasonable precautions to protect your data in transit, we cannot guarantee that all electronic communications will be free from interception, given the inherent risks of internet transmission.
By using our Software, you accept the risks associated with transmitting your Personal Information, including the possibility of data corruption, unauthorized interception, or system disruptions. Givium Foundation shall not be liable for any direct, indirect, special, consequential, or monetary damages including fines or penalties arising from your use of our Services or any related connectivity issues.
